By using wabisabipark.com (hereinafter: "Website") you accept and acknowledge the General Terms and Conditions recorded below (hereinafter: "GTC").
The operator and owner of the Website and the accompanying wabisabipark.com/en/webshop (hereinafter: "Webshop") and the designer and creator of the products distributed in the Webshop is Andrea Maszkály independent contractor (hereinafter: "Provider"). The current GTC contains the terms and conditions of ordering the products made available in the Webshop by the Provider. The condition of using the Website is accepting the GTC. If the User (hereinafter: "User") does not agree with the conditions set in the GTC, they cannot use the Website, and cannot initiate any purchases or downloads. The goal of the GTC is to inform the Customer (hereinafter: "Customer") about the contract coming into existence by ordering. The language of the contract is Hungarian.
The current GTC comes into effect on the day it is published on the Website (22.03.2022) and it applies to every User. The Provider may change the GTC, and the changes apply immediately after the date of publication. The changes do not affect orders already placed.
Issues not regulated by the GTC fall under the regulations of the Civil Code (Ptk) and other official regulations.

RANGE OF PROVIDED SERVICES
The Webshop sells graphics, games and materials that help learning for children of preschool and elementary school are only downloadable in an electronic format, some of which are available for free. Further information about the purchasable products can be found in the descriptions in the Webshop. After purchasing, the Customer gets the product in PDF format only, sent in e-mail. Printing the products is the responsibility of the Customer. The materials printed by the Customer may slightly differ from the sample images and photos presented in the Webshop, depending on the quality of the paper, the type and settings of the printer and the status of the print cartridges used, for which the Provider cannot be held responsible. The Customer acquires the right for personal use of the downloaded product, which cannot be assigned and re-authorized to any third party.
PROCESS OF PURCHASING
The Webshop is designed to be simple and user-friendly. The purchase can be made by following the steps below. Ordering the products is only possible through the Webshop in an electronic format. We do not fulfil orders made by telephone, sms, e-mail, postal mail or any other way.
Registration
Browsing the Webshop and downloading the "FREE" materials does not require a registration. Purchases, however, can only be initiated by registered Users. The data of the registered Users are recorded so that any new purchases can be made quicker and more conveniently. The data provided for the registration is treated as confidential and is not forwarder to any third party.
Downloading the "FREE" products
Registration is not required in order to download the products labelled as "FREE" in the Webshop. These products can be downloaded after clicking the details button and getting acquainted with the product information, then clicking the download button. After this, the Users can save the product in PDF format to their own device.
Downloading the "PATREON ONLY" products
These products can only be accessed by the supporter group registered on patreon.com, and they can download them for free. The button redirecting to Patreon’s website will appear after clicking the details button below the product in the Webshop. This user interface enables the User to join a variety of supporter groups, if they have not already done so. If the paid amount is sufficient for gaining access to the "PATREON ONLY" product in the Webshop, the Customer gets a link at the Petreon.com interface which redirects to wabisabipark.com, where they can save the material in PDF format by clicking the download button.
Choosing priced products
By clicking the webshop menu the desired product to be ordered has to be chosen from the displayed products. It is advised to read the product description thoroughly, because there is no opportunity to change products once they are ordered. The accessories that can be seen in the photos, but are not in the description are not subjects of the sale. The photos taken of the products may slightly differ from the samples printed at home by the Customers depending on the quality of the paper and the printer settings, so please take this into consideration before ordering. Claiming warranty or termination of the contract cannot be made by referring to these differences. The Provider does not take any responsibility for possible misinformation or incorrect data that might occur mistakenly in the product descriptions!
Placing priced products in the cart
The desired product to be purchased must be placed in the cart (by clicking the "Place in cart" button). A popup window indicates that the product was placed in the cart successfully, which can be acknowledged by clicking the "OK" button. In case of purchasing multiple products the process is the same. Placing the product or products in the cart does not result in a payment obligation.

The content of the cart can be checked anytime by clicking the "Cart" icon placed at the upper-right corner of the page. The price of the products and the total price of the order can also be checked here. If an item gets deleted from the cart by clicking "x", the cart automatically updates itself.
Adding a coupon code
The Customer can have discounts using a coupon. A valid coupon must contain a coupon code, the amount of discount indicated in percentage, and the duration of validity. The coupon cannot be validated outside the given period. If the Customer has a coupon that entitles them to such discount, they need to type the code in the "Coupon code" field after the listed products and click the "Validate" button. The amount of discount gets subtracted from the total price of the purchase automatically.
Purchases using Patreon discount
Patreon supporters (depending on type of supporter group) can purchase with different degrees of discount in the Webshop. If the Customer wants to validate this discount, they need to use the link given in the Patreon interface to log in to the Webshop, where they will already see the discounted prices corresponding to the supporter group. The process of choosing the products and placing them in the cart is based on the aforementioned steps.
Finalizing the content of the cart
Once all the desired products to be purchased are in the cart, the "Checkout" button has to be clicked. To continue shopping "I’d like to browse more" has to be clicked.
Checkout and giving purchase information
During the checkout the billing information has to be given, which is necessary for billing, paying special attention to the compulsory fields, which are indicated by an asterisk. We handle all data confidentially, according to how it is stated in the Privacy Policy. Modifying the data is possible in any state of the ordering, right until sending the order. Entering the e-mail address requires extra attention since the purchased product will arrive to the given address. In case you do not receive any e-mail from us in 72 hours, please contact us! The Provider does not take any responsibility for possible losses due to data given incorrectly. To finalize the purchase the Customer must accept the General Terms and Conditions by ticking the checkbox!
Finalizing the order
After checking the content of the cart, click the "Pay with PayPal" button to finalize the purchase. Attention! Submitting the order involves a payment obligation for the Customer! If you do not get a confirmation of the order within 48 hours, your offer will no longer be valid.
Payment
The product in PDF format only gets sent to the Customer after the payment. Payment in the Websop is made with or without a debit card through the popular PayPal system in electronic format. The Customer is automatically redirected to this interface.
If you already have a PayPal account, click the "Go to PayPal" button, then enter the e-mail address and password of the account.
If you do not have a PayPal account yet, you can pay by debit card within the system of PayPal. To do so, click the "Pay with Credit Card" sign, then enter the name of the card holder, the card number, type, expiration date and CSC security code, as usual.
Fulfilling the order, receiving the product
Free and "PATREON ONLY" products can be saved to the computer of the User in PDF format by clicking the download button.
In case of priced products the product in PDF format is sent to the e-mail address that the Customer specified, after the payment is completed. The deadline of fulfilling the order is maximum 48 hours from the payment.
The deadline of downloading is one month. That means the Customer must download the purchased product by clicking the link sent in the e-mail within one month the latest. The link becomes unusable after this one month period. The Provider does not take responsibility for losing any purchased products that are not downloaded within one month, if no complaint arrives from the Customer during this period.
In case any detail of the product does not comply with the product description (wrong product is sent or part of it is missing), please indicate this to the Provider, who will act in accordance with the paragraph about complaint handling.
Sending the invoice
In case of free and "PATREON ONLY" products there is no actual sale, therefore the Provider does not issue an invoice.
In case of Priced products the Customer acknowledges based on Law CXXVII of the year 2007, paragraph 175§ point (2) b), that the invoice is sent by the Provider in an electronic PDF format to the Customer’s e-mail address.
PRICES
Products available for free are always distinguished by the "FREE" label.
The "PATREON ONLY" content, which is only available for supporters, is not priced because it can only be required and downloaded by certain supporter groups of WABISABI PARK.
The prices indicated in the Webshop are gross prices stated in forint (HUF), which do not include any value added tax (VAT), because the product distribution of the Provider is exempt from value added tax.
If any errors may occur in the Webshop related to the given prices in spite of the thoroughness of the Provider, or an error of the IT system, e.g.: obviously false or incorrect data in the order, the Provider has the right to delete those and is not responsible for any losses resulting from this. The Provider reserves the right to modify the incorrect prices.
We inform the Customer immediately after the correction. They have the opportunity to purchase the product in its real price or to cancel the order.
Because of the electronic format of the sale, there is no delivery fee charged.

The discounted prices for Patreon supporters are only indicated by the system if the User navigated to the Webshop using the current monthly link published by Patreon.
If the Customer wants to validate a discount with the help of a coupon, they can do that based on the information found above (see "Adding coupon codes").
CONDITIONS OF THE CONTRACT
The order is considered as an electronic contract, for which the standards are the electronic commerce services, law V. of the year 2013 about the Civil Code, and law CVIII. of the year 2001 about certain questions of services related to the informative society. The contract falls under the 45/2014 (II.26) government regulation about contracts between absent parties, and takes into consideration the 2011/83/EU regulations of the European Parliament and Council.
The current document is not filed and is only written in an electronic format.
RIGHT OF WITHDRAWAL
The Customer has the right to withdraw without reason within the deadline specified by the second paragraph of the 45/2014. (II.26) government regulation about the detailed rules of contracts between the consumer and the contractor. There are some exceptional cases listed below, when the right of withdrawal cannot be applied:

- according to paragraph 29§ point (1) m) in case of digital content provided in a non-physical storage medium, if the contractor started the fulfilment with the agreement of the customer in advance, and at the same time the consumer declared that they acknowledged the loss of right of withdrawal after the start of the fulfilment.

- according to paragraph 29§ point c) any product that was not pre-produced, which was created based on the instructions or request of the consumer, in case of any product that was obviously personalised to the consumer.
WARRANTY
If the ordered product is faulty or any of its details do not comply with the product description (the wrong product was sent or part of it is missing), the Provider fulfils the warranty request of the Customer if it is indicated to the Provider in 60 days from noticing it. The Customer can ask for the immediate repair or replacement of the product, or if it is not possible, they can request appropriate remuneration, or at the very least they can withdraw from the contract. After investigating the complaint, if it is real and is due to a simple mistake, the provider sends the appropriate or repaired product to the User. If the file replacement is caused by a simple system failure that blocks the sending, opening or readability of the product in PDF format, the problem may result in further investigation, and the Provider must indicate the duration of this to the Customer. After 6 months of the purchase the Customer needs to prove that the product was already faulty at the time of the purchase. In case this cannot be done, the Provider is under no obligation to fulfil the warranty request.
PROCESS OF RESOLVING COMPLAINTS
The Provider must give a written response within 30 days to the complaints received to one of the available contacts listed earlier in written or electronic format. For identification purposes the Customer has to give the details of the order. Complaints received by phone will be investigated immediately and a solution will be offered. If the Customer does not agree with that, they need to forward their complaints in a written format, and the Provider must reply to that within 5 workdays. In case of any dispute the consumer can turn to the competent Conciliation Committee of Budapest (headquarters: 1016 Budapest, Krisztina krt. 99. III. em. 310., post address: 1253 Budapest, Pf.: 10., e-mail: bekelteto.testulet@bkik.hu).
DATA PROTECTION
By registering in the Webshop and making a purchase, the User agrees to handling and storing their data in a database.
The Provider handles the data of the User confidentially in compliance with the current laws and does not hand them over to any third party, taking into consideration law LXIII. of the year 1992 about protecting personal data, and public access of public data, and law VI. of the year 1998 about the protection of individuals when computer-processing their personal data.

COPYRIGHT
All written and visual content (graphics, graphical elements, photos, details of web design, logos, videos, text, data, other information, including free content (hereinafter: "Content") displayed in the wabisabipark.com web page is exclusively owned by Andrea Maszkály and is protected by copyright as stated in law LXXVI. of the year 1999 about copyrights. Further details are in the Copyright notice.
COOKIES
The web page uses cookies to optimize user experience. Further information can be read in the detailed Privacy Policy.
RESTRICTING RESPONSIBILITY
The Provider cannot be made responsible for the following points:
  • Possible misunderstandings or losses due to misspellings in visual and textual content. The User should indicate such misspellings and they will be corrected.
  • Any arising problems related to language, reading and writing, any injuries or damages caused during gameplay with the downloaded content. Pre-school and school education cannot be substituted with the content found on the web page. The downloadable contents are only playful practice exercises, and the use of these should be decided by the parents or the fosterer of the child, and the method of using the content depends on them.
  • Any damages resulting from network problems that occur during the use of the web page.
  • Possible damages resulting from insufficient information or misinformation published on the internet.
  • Lack or error of software that is necessary for reading the purchased PDF format materials.
  • Problems arising during downloading the purchased PDF on the User’s side, e.g. failure of download because of lagging WiFi connection, filled storage space or use of an unsupported web browser.
  • Unsuccessful download, in case the User exceeds the one month download deadline and no letter of complaint is received during this period.
  • Unsuccessful download of "PATREON ONLY" products, in case the reason of the unsuccessful download is one of the following: 1. The User is no longer in supporter status at the desired time of download. 2. The User is still in supporter status, but missed the opportunity to download supporter content published earlier. 3. The User changed supporter status, therefore they are no longer entitled to download content connected to their earlier status.
  • Product or device errors that occur during the printing of the purchased product, and any damage that occurs because of inadequate choice of paper thickness.
  • Quality of printing.
  • If the Customer accidentally deletes the product.
  • Any direct or indirect damage that affects the Customer during browsing the Webpage or Webshop, or resulting from connecting to it.
  • Any damage that results from the Customer granting access to their personal data or password to unauthorized people.
  • Any User damage caused by third party.
  • Damage resulting from a vis major event.
